Can I object to a UWV decision?

Sometimes you may disagree with a decision made by the UWV. You can object to this decision in a number of cases. You can only object to a UWV decision if this is also stated in the UWV decision itself. However, you cannot object to a UWV decision on a request for dismissal. If you file an objection, keep in mind that the decision remains valid as long as there is no response to your objection.

Can I object to an expert opinion from the UWV?

An expert opinion from the UWV cannot be objected to, because it is not a decision, but the efforts made by the employer or employee have been considered. It is not binding and not a decision. Therefore, you cannot object to it.

How can you object?

You can submit your objection to UWV by mail or online.

Online

You can object directly online, for this you need your DigiD. You can only object online if you object yourself. An authorized representative cannot object via online.

By mail

If you cannot object online, you can do so by mail: with a form or by letter. It is best to send your objection by registered mail. Even if you send it to the UWV's postal address. Then you can always prove that you sent it on time.

By what deadline should I file an objection?

The letter containing UWV's decision tells you how soon you must file a notice of objection. Usually this is within six weeks of the date of the decision letter. For some Sickness Act decisions, this period is shorter, namely two weeks. Make sure your notice of objection is on time, otherwise the UWV cannot process it. Has the UWV received your objection? Then you will hear from the UWV within five working days.

Do you need more time?

Do you need more time? Then you can file a preliminary objection. You can file a preliminary objection when you need more time to object. Perhaps you need more time because you have not yet gathered all the information or you still need to consult with someone, a lawyer for example. In these cases, you can file a preliminary (pro forma) objection.

In a preliminary objection, you put all the details except why you are objecting. You put in the preliminary objection that you will send the reasons as soon as possible. You will then hear from UWV when you must send the reasons for the objection at the latest.
